Re: Kentucky Governor trying to crack down on Online Gambling
Sooner or later one smart person in the government will talk the others into legalizing online gambling in America, and then we can all go about our personal business again of playing online, without their worries.

Re: Kentucky Governor trying to crack down on Online Gambling
The judge is supposed to rule on this case later today. I'll keep everyone updated.
Cross your fingers.
If Beshear gets his way, I can just see it now. It'll be a huge avalanche. What's going to happen when the bible belt decides that they don't want citizens of their state viewing adult material online? Are they going to start filtering/blocking all porn sites in that state?
And even if that doesn't happen, how many of the 11 "banned states" (Illinois, Michigan, New Jersey, Washington, Indiana, Wisconsin, Louisiana, Oregon, Nevada, South Dakota) are going to follow Beshear's lead and launch another attack against online gambling?
....side note: Just curious as to when Microgaming is going to add Kentucky to that list, making it 12 banned states...

It seems that the ruling has been pushed back to Thursday....

Re: Kentucky Governor trying to crack down on Online Gambling
haha, I love their reasons for delaying the decision:
Quote:
A computer malfunction has delayed the ruling by Judge Thomas Wingate over whether the southern American state of Kentucky has the right to seize 141 domain names associated with online gambling.
Although a decision was expected last Wednesday in the civil action brought last month by Michael Brown, Secretary of Justice and Public Safety, on behalf of the Commonwealth of Kentucky, the Franklin County Circuit Court delayed its pronouncement by a week in order for Judge Wingate to better consider the matters involved.

Re: Kentucky Governor trying to crack down on Online Gambling
Sigh. Does anyone across the pond or up north need a room/flatmate?
I'm almost embarrassed to be an American, anymore.
I hope this is not the end to the fight, and they take this case all the way to the US Supreme Court.
They've opened Pandora's Box with this ruling. Combine this, and the Republicans stance against online gambling; and I could see McCain censoring EVERY STATE by not allowing anyone in AMERICA to even VIEW a gambling website, let alone play at one.

Judge allows gambling Web site case to proceed

FRANKFORT, Ky. (AP) - A Franklin County Circuit Court judge has refused to dismiss a lawsuit seeking to block access to online casinos in Kentucky.
Judge Thomas Wingate said in an order Thursday afternoon that he will hear arguments on Nov. 17 before deciding whether to give Kentucky state government control of the domain names of 140 of the Internet's most popular gambling Web sites.
Wingate said online casinos that don't block access to their Web sites in Kentucky could be ordered to forfeit their domain names.
Gov. Steve Beshear's administration filed the lawsuit. Beshear supports legalizing casino gambling in a state that already allows betting on horse racing, bingo and a state lottery.

Re: Kentucky Governor trying to crack down on Online Gambling
For those that are interested, here are the official court papers (PDF Format) from Judge Wingate regarding yesterday's ruling to allow this case to continue.
Also, how can you list "141 Internet Domain Names" as defendants?

Re: Kentucky Governor trying to crack down on Online Gambling
Interesting comments from a legal scholar
Quote:
PND: In your opinion, how did this case progress this far, to the point that a final forfeiture hearing is scheduled for December?
Rose: You have an activist Governor, who is actually in favor of casinos and just doesn’t like the internet, and a judge who was willing to go along with him. I don’t consider myself to be on one side or another, but I would think that any Appeals Court would look at this and say that there are too many problems with it.
PND: If one of your clients owned one of the 141 domain names in question, what would you advise them to do?
Rose: I would advise my clients to block Kentucky residents. There is no real downside to doing that. Kentucky isn’t a major market. The Judge made it clear if companies didn’t block Kentucky residents, then their name will be forfeited. You don’t want to become the test case. All you’re giving up is the little market of Kentucky. If a bunch of other states start copying, then you have to fight it, but for now, you have to leave the market even though Kentucky might be in the wrong.

Re: Kentucky Governor trying to crack down on Online Gambling
I have a short and reasonable idea; cut the state of Kentucky from the internet altogether.
No more problems.
