Re: Kentucky Governor trying to crack down on Online Gambling
Heh, I like it! I am sure Joe the Plumber could put a bypass valve in those internet pipes so that it flows around Kentucky altogether.
Better yet, why doesn't Kentucky expand their online racebook to include sports betting, poker and casino gaming for Kentucky residents only?

Re: Kentucky Governor trying to crack down on Online Gambling
We've won another small victory. The appellate court of Kentucky has allowed iMEGA to plead their case, and have pushed back the forfeiture hearing, originally scheduled for December 3rd, to December 12th.
Quote:
The Interactive Media Entertainment & Gaming Association (iMEGA), an Internet trade association in Washington, DC, asked the appeals court to stay the forfeiture hearing ordered by district court Judge Thomas Wingate scheduled for Dec. 3rd, until the appeals court had an opportunity to consider iMEGA’s petition to have the lower court seizure ruling overturned. A hearing to consider that petition has been scheduled for Dec. 12th in Louisville.
“We’re please that the Court of Appeals has given us the opportunity to challenge these seizures,” said Joe Brennan Jr., iMEGA’s chairman. “The commonwealth has tried to take these domains for their own financial gain, violating Kentucky law, exceeding their jurisdiction, and setting a terrible precedent in the process.”

Right now, the Kentucky court of appeals has heard arguments from various groups, and we're awaiting their decision....

Re: Kentucky Governor trying to crack down on Online Gambling
Poor Beshear. He lost his case. I seriously doubt that Kentucky will pursue this matter any more. At least the appellate court Judges knew how the Internets work and that it's not just a bunch of Tubes.

FRANKFORT, Ky. (AP) — Kentucky may not seize 141 online casinos' Internet domain names in an attempt to block them from operating within the state's borders, a three-judge appeals panel ruled.
In a 2-1 opinion Tuesday, the Kentucky Court of Appeals panel said an Internet domain name is not a gambling device. That left the Franklin County Circuit Court without jurisdiction in the matter.
"It stretches credulity to conclude that a series of numbers, or Internet address, can be said to constitute a 'machine or any mechanical or other device ... designed and manufactured primarily for use in connection with gambling,'" Judge Michelle Keller wrote in the majority opinion. "We are thus convinced that the trial court clearly erred in concluding that the domain names can be construed to be gambling devices subject to forfeiture."
The state sued the Web sites after determining that they allowed Kentuckians to gamble illegally and asked a judge to either force the sites to block Kentucky users or allow the state to take possession of the domain names. Kentucky already allows gambling on horse racing and bingo and has a state lottery.
Attorneys for the state and the Web sites have estimated that about 13,000 people in Kentucky use the online casinos.
Gov. Steve Beshear spokeswoman Jill Midkiff said officials had received the ruling late Tuesday, were still studying it and had not decided what the state's next step would be.
The appellate panel also ruled the circuit court cannot hold a hearing on whether Kentucky may seize the domain names. Keller's opinion said it's up to the General Assembly — not the courts nor the state Justice Cabinet — to bring domain names into the definition of illegal gambling devices.
Jeremiah Johnston, president of the Washington D.C.-based Internet Commerce Association, said he was pleased by the ruling. Still, Johnston said the court did not address whether the state had the authority to involve itself in seizing domain names of internationally based companies.

That's right on.
I think the much older computers use to have tubes. Perhaps Beshear had thought that is how the internet works today.

I guess you could say, in his point of view, that the internet is a big vaccuum cleaner.
What he's saying; when we turn on our pc's and hook up with the internet, all of the gambling industrial clogs up our tubes with about their business.
What I'm saying; what a bunch of .
