They have blocked US players from money play. If a player choses to play overseas, they are still breaking the TOS. Partypoker have done similar in the past for minor breaches so I wouldnt feel too confident waiting for a 100k check. In this unregulated industry, it is guilty until proven innocent and the breach of TOS wont help the matter

If you really want to get technical, unless you are in one of the 13 states that have specific laws against online gambling, you are not breaking the
law by playing.
I do agree about the "guilty until proven innocent" motif, but in all reality, the UIGEA only makes it "illegal" for payment processors to transfer funds from an American account to an online casino. In no way does it make online gambling illegal, in a universal form.
In fact, Pennsylvania and South Carolina judges recently ruled that poker is a game of skill, and therefore, not gambling. This opens sooooo many doors. If I wanted to push the issue, I could argue this fact with PartyPoker, and they'd be hard pressed to give me a reason as to why I couldn't play on their poker site, because in all actuality, as a resident of Pennsylvania, it is 100% legal for me to play poker for money - online or off.
The same goes for California. There have been
legal land-based card rooms in existence for over a decade in their state.
